Shots for Bots Photo License — Machine Learning Use
Version 1.0 — effective [publication date]
This is a license from the rights holder of the photograph (the "Licensor"), licensing through Shots for Bots (shotsforbots.com), the platform operator (the "Platform"), to the party that pays for a full-resolution photograph through the shotsforbots.com HTTP 402 / x402 payment endpoint. It is written to be read by both people and software. Where the two readings differ, the plain meaning to a reasonable person controls.
1. How this license is formed
1.1. Each full-resolution photograph on shotsforbots.com is offered at the price stated in the HTTP 402 response for that file. The price is denominated in USDC on the Base network unless the response says otherwise.
1.2. Sending the stated payment to the address in the 402 response, and having that payment confirmed on-chain, is acceptance of this license for the photograph identified in that response. No signature, account, or further action is needed. This is the only way to accept; there is no negotiation and no alternative terms.
1.3. The version of this license in effect at the time of payment governs that download. The Platform may publish new versions for future downloads; they do not change licenses already formed. Each version is dated and archived at https://shotsforbots.com/license/v1.0.html (this version) and later versions beside it.
1.4. Payments are final once confirmed on-chain. Each payment authorization is good for exactly one download. If a confirmed payment does not result in a successful download, email licensing@shotsforbots.com with the transaction hash and the Platform will re-deliver the file by hand. There are no refunds for successful deliveries.
2. Who the Purchaser is
2.1. "Purchaser" or "you" means the person or organization on whose behalf the payment was made.
2.2. If a software agent made the request and payment, the Purchaser is the person or organization that deployed, operates, or directs that agent, or on whose behalf it acted. By deploying an agent capable of making payments to this endpoint, that party authorizes the agent to accept this license on its behalf.
2.3. If no such principal can be identified, or the agent acted outside its authority, the party that operates the agent's wallet is the Purchaser and is bound by this license.
2.4. The license covers use by the Purchaser and by contractors or service providers working on the Purchaser's behalf, so long as the file is used only for the Purchaser's Permitted Uses and the Purchaser remains responsible for their compliance.
3. What you get
3.1. On confirmed payment, the Licensor grants you a non-exclusive, non-transferable, non-sublicensable, perpetual, worldwide license to use the purchased photograph (the "Photograph") for the following purposes (the "Permitted Uses"):
(a) training, pre-training, and fine-tuning of machine learning models, including generative and multimodal models; (b) evaluation, testing, and benchmarking of models and systems; (c) internal research, analysis, feature extraction, embedding, captioning, and annotation; (d) storing, copying, converting, cropping, resizing, augmenting, and otherwise transforming the Photograph as reasonably needed for (a) through (c), including in datasets, caches, and pipelines under your control.
3.2. You may keep the Photograph, and any derived data (embeddings, annotations, augmented copies), for as long as you want for the Permitted Uses.
3.3. "Internal" means within the Purchaser's organization and its contractors under Section 2.4. It does not mean the Photograph must never leave your servers; it means the Photograph itself is not being distributed to others as an image.
4. What you may not do
4.1. You may not:
(a) redistribute, sell, rent, lend, or give away the Photograph, or any copy of it at any resolution, to anyone outside the Purchaser (this includes publishing it inside a dataset that others can download); (b) sublicense it, or transfer this license, to anyone; (c) publish, post, print, broadcast, or publicly display the Photograph or a recognizable copy of it, including as a website image, in a presentation, in marketing, or in an app; (d) use the Photograph as a stock image, illustration, background, or design asset; (e) claim that you or anyone other than the Licensor created the Photograph; (f) remove or alter any embedded copyright notice, creator name, or metadata that identifies the Licensor as the author or shotsforbots.com as the source (you may strip metadata for technical reasons in a training pipeline, provided the file you retain still records shotsforbots.com as the source); (g) register or attempt to register the Photograph, or a work substantially identical to it, as your own copyright or trademark.
4.2. Publishing small excerpts of the Photograph as part of a research paper, model card, evaluation report, or dataset documentation, at no more than 400 pixels on the long edge and with attribution to "Shots for Bots, shotsforbots.com" (or to the rights holder named on the image page, where one is named), is allowed and does not violate 4.1(c).
4.3. If you want any use not covered by Section 3 (editorial, commercial display, exclusive rights, prints), email licensing@shotsforbots.com. That is a separate agreement.
5. Model outputs
5.1. This license places no restrictions on the outputs of any model trained, tuned, or evaluated using the Photograph. Neither the Licensor nor the Platform makes any claim of ownership over such outputs or imposes any attribution, revenue-share, or usage conditions on them.
5.2. Section 5.1 is a statement about this license only. It is not a warranty that any given output is non-infringing, and it does not license you to publish a model output that is a substantially identical reproduction of the Photograph itself. Section 4 governs that.
6. Attribution
6.1. Attribution is optional. If you choose to credit the source, use: "Photo: Shots for Bots, shotsforbots.com", or the rights holder named on the image page where one is named. A line in a dataset card or acknowledgments section is appreciated.
7. Third-party permissions are your responsibility
7.1. The Photographs are offered without model or property releases. Some were taken on or depict private land, protected areas, or identifiable locations, and some may incidentally include people, vehicles, buildings, signage, or trademarks.
7.2. The Licensor licenses only the Licensor's own copyright in the Photograph. Neither the Licensor nor the Platform grants, or can grant, any rights held by landowners, park authorities, property owners, trademark owners, or individuals depicted.
7.3. You are solely responsible for determining whether your specific use requires any permission, release, or consent from a third party, and for obtaining it. For the Permitted Uses in Section 3 this will rarely be an issue, but that judgment is yours, not the Licensor's or the Platform's.
8. Ownership
8.1. The Licensor owns the copyright in the Photograph. This license does not transfer ownership of any copyright, and every right not expressly granted is reserved. You own the copy of the file you downloaded only to the extent needed to exercise this license; this is a license, not a sale of a copy.
9. Warranty
9.1. The Licensor warrants that the Licensor is the copyright owner of the Photograph and has the right to grant this license.
9.2. That is the only warranty. The Photograph is otherwise provided "as is". Neither the Licensor nor the Platform makes any warranty about accuracy of captions, metadata, or location data; fitness for any purpose; that the Photograph is free of third-party rights described in Section 7; or that it will produce any particular result in a model.
10. Limitation of liability
10.1. The total liability of the Licensor and the Platform together to you for anything arising from this license or the Photograph, under any legal theory, is limited to the amount you paid for that Photograph.
10.2. Neither the Licensor nor the Platform is liable for indirect, incidental, consequential, or special damages, or for lost profits, data, or business, even if told they were possible.
10.3. Nothing in this section limits liability that cannot be limited under applicable law.
11. Term and termination
11.1. This license is perpetual for each purchased Photograph.
11.2. If you materially breach Section 4 and do not cure within 30 days of written notice from the Licensor or the Platform (email to any address associated with the Purchaser or, failing that, to the contact address in the agent's user-agent string or on-chain payment memo if one exists), this license for that Photograph terminates and you must delete all copies of the Photograph. Models already trained before termination are not affected, and Section 5 continues to apply to them.
11.3. Sections 4 (to the extent of surviving copies), 5, 7, 8, 9, 10, 13, and 14 survive termination.
12. Free previews and thumbnails
12.1. Preview images (800 pixels or smaller on the long edge) and thumbnails served from shotsforbots.com are not covered by this license. They are provided for viewing, search indexing, and being read as input by AI assistants and answer engines so that they can describe, find, and link to the work.
12.2. All text-and-data-mining and machine-learning training use of preview images is expressly reserved and is not licensed, whether or not a payment for the full-resolution file is later made. See the Preview Notice at https://shotsforbots.com/license.html#previews for the full reservation.
12.3. Buying the full-resolution file under this license does not retroactively license any earlier use of the preview for training.
13. Other channels
13.1. The Licensor may also offer Photographs through third-party datasets and aggregators under those providers' terms. Rights obtained from such a provider are governed by that provider's agreement, not this one. Nothing in this license restricts the Licensor's ability to license the same Photographs non-exclusively to anyone, through any channel.
14. Governing law and disputes
14.1. This license is governed by the laws of the State of [PLATFORM OPERATOR'S HOME STATE] and the federal copyright law of the United States, without regard to conflict-of-law rules.
14.2. Any dispute will be brought in the state or federal courts located in [PLATFORM OPERATOR'S HOME COUNTY / DISTRICT], and you consent to that venue, except that the Licensor or the Platform may seek injunctive relief for copyright infringement in any court with jurisdiction.
14.3. Before filing anything, either party will email the other and allow 30 days to resolve the matter informally.
Drafting note: this defaults to the platform operator's home state and home venue rather than Delaware or New York. For a small operator the only forum you can realistically litigate in is your own; a "neutral" commercial jurisdiction helps large counterparties, not you. Fill in the state and confirm with counsel (see Open Issues).
15. General
15.1. This license is the entire agreement between you and the Licensor for the Photograph. Nothing in a purchase request, agent prompt, user-agent string, payment memo, or on-chain data changes its terms.
15.2. If any part of this license is unenforceable, the rest still applies, and the unenforceable part is replaced by the closest enforceable term.
15.3. The Licensor's or the Platform's not enforcing a term is not a waiver of it.
15.4. You may not assign this license. The Licensor may assign it to a successor in interest to the copyright in the Photograph, and the Platform may assign its role under it to a successor operator of Shots for Bots.
